Terms of Use

By downloading, installing, or using Rail ("the App"), you agree to these Terms of Use. If you do not agree, please do not use the App.

Rail is a train-tracking app for iPhone that watches a UK rail journey you choose and notifies you of platform changes, delays and cancellations, with a Live Activity on your lock screen. The App requires an account, created with Sign in with Apple, and holds the data described in our Privacy Policy in order to send you notifications.

The App contains data from National Rail Enquiries (Darwin) and Network Rail Open Data, used under their licences. That data is produced by train operators and infrastructure systems, not by us, and it can be incomplete, wrong or late. The App relays it as quickly as it can and shows clearly when a platform or time is an estimate rather than a confirmed fact, but it cannot guarantee that any notification is accurate or arrives in time. The App is not a substitute for official station announcements, departure boards or staff instructions, and you remain responsible for your own travel decisions. Do not rely on the App alone for a connection, a booked seat or a train you cannot afford to miss.

The App is free to use during its beta period. We may in future offer some or all of its features under a paid subscription or other in-app purchase. If we do, the price and what it covers will be shown in the App before you are asked to pay, any purchase will be made through Apple's in-app purchase system under Apple's terms, and you will never be charged without agreeing to it. Features you have been using for free may become part of a paid tier; we will give reasonable notice in the App before that happens.

You need an Apple ID to use the App. You are responsible for the device and account you use to sign in. You may delete your account at any time from the App's settings or by contacting us, which removes the data described in our Privacy Policy. We may suspend or delete an account that is used to abuse the service, for example by placing an unreasonable load on it.

The App is for personal use in tracking journeys. You must not attempt to access its server other than through the App, scrape or redistribute the data it provides, or interfere with its operation. The rail data is provided to you under the licences of its owners and may not be extracted from the App for other purposes.

The App, including its design, code, and content, is owned by Sammy Sergi. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. Rail data remains the property of its respective owners.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law, or under any other law, that cannot be excluded, restricted, or modified by agreement.

Subject to the paragraph above, the App is provided "as is" without warranties of any kind, and to the fullest extent permitted by law Sammy Sergi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including a missed train, a missed connection, a wasted ticket or any other loss resulting from information that was wrong, late or missing. Where liability cannot be excluded but can be limited, it is limited to resupplying the App or, if you have paid for it, refunding the amount you paid for the period affected.

The App depends on third-party rail feeds, Apple's push notification service and our own hosting, any of which may be interrupted. We aim to keep the service running and to say so in the App when a feed is unavailable, but we do not guarantee uninterrupted availability, and we may change, suspend or discontinue the App or any feature at any time.

We may update these Terms from time to time. Changes will be reflected on this page with an updated date. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms are governed by the laws of New South Wales, Australia. You and Sammy Sergi each submit to the non-exclusive jurisdiction of the courts of New South Wales and of any courts competent to hear appeals from them.
